CVC Inquiry Sought Over Alleged Bias and Irregularities in NBCC EMRS Tenders in Chhattisgarh

Complaint alleges restrictive eligibility criteria, favouritism, and violations of transparency in nearly 18 EMRS project tenders

New Delhi: A complaint has called for an extensive inquiry by the Central Vigilance Commission (CVC) and the National Buildings Construction Corporation’s (NBCC) Chief Vigilance Officer (CVO) over alleged favouritism, restrictive tender conditions, and procedural irregularities in EMRS projects in Chhattisgarh.

Complainant Chaitanya Paik has alleged that the NBCC Ranchi Zone introduced restrictive conditions in tenders for nearly 18 EMRS projects, effectively preventing contractors already executing two EMRS projects from participating in new bids. According to the complaint, these contractors possessed adequate bidding capacity and had substantially completed their ongoing works, yet were rendered ineligible due to the imposed tender conditions.

The complaint contends that these eligibility criteria are contrary to the principles of fair competition, transparency, and equal opportunity, and appear to be inconsistent with the spirit of the General Financial Rules (GFR), Central Vigilance Commission (CVC) guidelines, and the CPWD Works Manual.

Further allegations relate to EMRS projects located in Mohla, Jashpur, and Manora, where the complainant claims that the tender process was designed to benefit certain pre-determined preferred contractors. It also alleges that during the second stage of the bidding process, several bidders were technically disqualified on the grounds that their physical documents were not received within the stipulated time, raising further concerns about the fairness and transparency of the evaluation process.

The complaint calls for an independent vigilance inquiry into the entire tender process and requests that all further action on the concerned tenders be kept in abeyance until the investigation is completed. It also seeks the issuance of necessary guidelines to ensure that future EMRS tenders are conducted through an open, competitive, and transparent procurement process.
